1. Acceptance of Terms

By accessing or using the Garapano mobile application, website, and related services, you agree to be bound by these Terms of Service  and the Privacy Policy.

If you do not agree to these Terms, you must discontinue use of the Platform immediately.

2. Eligibility and Account Responsibilities

You must be at least 18 years of age to create an account or use the Platform.

By creating an account or using Garapano, you agree to:

  • Provide accurate, current, and complete information

  • Maintain the confidentiality of your login credentials

  • Accept responsibility for all activities conducted under your account

You may not sell, assign, share, or transfer your account to another person.
Garapano reserves the right to suspend or terminate accounts that violate these Terms or pose a risk to users or the Platform.

3. Platform Role and Scope

Garapano is a digital marketplace platform that facilitates connections between property seekers, property owners, and authorized agents.

Garapano does not:

  • Own, manage, inspect, or verify properties

  • Act as a broker, agent, landlord, or legal advisor

  • Participate in negotiations, payments, or contracts between users

  • Guarantee property ownership, legality, condition, pricing accuracy, or availability

All rental or sale agreements are entered into directly between users, and Garapano is not a party to such agreements.

4. Identity Verification (KYC)

Users who list properties are required to complete an identity verification process.

Identity verification:

  • Confirms the identity of the listing user only

  • Does not verify property ownership, legal compliance, condition, safety, pricing accuracy, or suitability

Users are solely responsible for conducting independent due diligence before entering into any transaction.

5. Property Listings and User Content

5.1 Accuracy and Authority

You are solely responsible for the accuracy, legality, completeness, and authenticity of all content and listings you upload.

By listing a property, you represent and warrant that you are the lawful owner or an authorized agent with the right to advertise the property.

5.2 Acceptable Use

You may not upload, post, or transmit content that is:

  • Fraudulent, false, or misleading

  • Unlawful or infringing on third‑party rights

  • Offensive, abusive, deceptive, or inappropriate

Garapano reserves the right to review, remove, restrict, or disable access to content that violates these Terms or applicable law.

5.3 Image and Media Guidelines

Uploaded images and media must:

  • Accurately represent the listed property

  • Not include phone numbers, email addresses, logos, promotional text, or watermarks

  • Comply with Garapano’s content and community standards

6. License to Use Content

By submitting content to Garapano, you grant Garapano a non‑exclusive, royalty‑free, worldwide license to host, store, reproduce, display, and distribute such content solely for the purpose of operating, improving, and promoting the Platform.

You retain full ownership of your content.

7. Transactions, Payments, and User Interactions

Garapano is not a party to any agreement, transaction, or communication between users.

Garapano:

  • Does not process payments

  • Does not collect, hold, or transfer user funds

  • Does not provide escrow, payment protection, or dispute resolution services

All matters related to payments, cancellations, refunds, disputes, or enforcement of agreements are handled exclusively between users, except where required by applicable law.

8. User Responsibility and Assumption of Risk

You acknowledge that engaging with property listings, viewings, rentals, or purchases involves inherent risks.

To the maximum extent permitted by law, Garapano is not responsible for losses, damages, injuries, or disputes arising from user interactions, listings, or agreements.

Nothing in these Terms limits or excludes rights that cannot be waived under applicable consumer protection laws.

9. Account Suspension and Termination

You may delete your account at any time through the app settings.

Garapano may suspend or terminate your account if you:

  • Violate these Terms

  • Engage in fraudulent, misleading, or unlawful activity

  • Pose a risk to other users, the Platform, or Garapano’s reputation

Termination may result in loss of access to content or services.

10. Limitation of Liability

The Platform is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, Garapano shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform.

This limitation does not apply to liability that cannot be excluded under applicable law.

11. Indemnification

You agree to indemnify and hold harmless Garapano, its affiliates, officers, partners, and employees from any claims, damages, losses, liabilities, or expenses arising from:

  • Your use of the Platform

  • Your content or listings

  • Your violation of these Terms or applicable law

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Zimbabwe, without regard to conflict‑of‑law principles.

Nothing in this section limits mandatory rights provided under applicable consumer protection laws.

13. Changes to These Terms

Garapano may update these Terms from time to time. Updated Terms will be effective upon publication within the app or on the website.

Continued use of the Platform constitutes acceptance of the revised Terms.
